U.S. TRO / Schedule A Defense & Settlement

Store or marketplace funds frozen by a U.S. temporary restraining order (TRO)? We help cross-border sellers named in Schedule A cases with case review, risk assessment, settlement negotiation, litigation defense, and asset release.

What we help with

  • Case review
From a platform notice or case number, we confirm the plaintiff, plaintiff's counsel, court, asserted rights, TRO / preliminary injunction (PI) status, and key deadlines.
  • Infringement risk assessment
We compare the asserted trademark, patent, or copyright against your listings, images, and titles to gauge exposure and available defenses.
  • Settlement negotiation
Using your sales data, the strength of the evidence, and the plaintiff firm's usual approach, we negotiate settlement amount and terms to get funds released quickly.
  • Litigation defense
Where appropriate, we challenge overbroad asset freezes, improper joinder, jurisdiction or service defects, and raise non-infringement or invalidity defenses.
  • Asset release & account recovery
We follow through on settlement, dismissal, or court orders and coordinate with the platform to lift the freeze.
  • Compliance & prevention
After the case, we help review your catalog for IP risk to reduce the chance of future suits.

First steps after a notice

Keep the platform notice, plaintiff emails, affected listings, and sales records. Hold off on replying to plaintiff's counsel or signing anything until counsel has reviewed.

Preserve • Assess quickly

Typical matters

Frozen store funds

A platform notifies you that your account is frozen under a U.S. court order and payouts are blocked.

TRO converted to a preliminary injunction

The case has moved to the PI stage, the freeze will last longer, and a strategy is needed quickly.

Settlement demand received

Plaintiff's counsel has sent a settlement demand and you need to know whether it is reasonable.

How we work

  • 1. Review the case
Confirm the case number, plaintiff, asserted rights, frozen amount, and court deadlines.
  • 2. Assess risk and options
Compare the accused products and weigh the cost and likely outcome of settlement, defense, or other paths.
  • 3. Settle or defend
Move forward with negotiation or court filings on the path you choose, with regular updates.
  • 4. Release and close out
Track dismissal or orders, coordinate the platform release, and provide follow-up compliance advice.

Frequently asked questions

  • How quickly do I need to act?
TROs are short-lived, and plaintiffs typically move for a preliminary injunction soon after. Have the case reviewed promptly; the controlling deadlines are those in the court record.
  • How much do settlements usually cost?
There is no fixed figure. It depends on accused sales, evidence strength, and the plaintiff firm's strategy. We give a reference range after review.
  • What happens if I ignore it?
If a defendant does not appear, the court may enter a default judgment and frozen funds may be applied to it.
  • I'm outside the U.S. Can I still defend?
Yes. The case is handled by U.S.-licensed counsel; you usually do not need to travel to the U.S.
